Parents, students and adult learners are asked to read this section carefully. Applications for courses are only acceptable if parents and students are fully aware of these Terms and Conditions and agree to them.
1. Booking & Payment
You must complete and sign an enrolment form and send this to New Forest Language School. Once we have received your enrolment form, you will be sent a confirmation of your place on the course and an invoice showing your course fees and the deposit, which must be paid on receipt of this invoice. The deposit will not be refunded under any circumstances, unless we have to cancel the course due to low numbers of students or other unforeseen circumstances. We reserve the right to decline any booking.
The balance and any transfer costs will be invoiced 8 weeks prior to the start of the course and MUST be paid by the date specified on the invoice. Should the balance fail to reach New Forest Language School 6 weeks before the start of the course, we reserve the right to cancel the booking without refund. If you apply less than 10 weeks before the commencement of the course you will be invoiced for the full amount.
All payments must be paid in Pounds Sterling and all cheques must be drawn on a UK clearing bank. All other kinds of payments will incur charges. New Forest Language School will not be responsible for any bank charges incurred in the transfer of money.
2. Cancellation charges
All enrolments are non-transferable but may be cancelled or postponed provided that WRITTEN notice is received by New Forest Language School. Cancellation charges will be incurred as follows:
- Less than 14 days before the commencement of the course: 100% of the course fees,
- 14 - 30 days before the commencement of the course: 50% of the course fees,
• More than 30 days before the commencement of the course: the amount of the deposit.
Please note that if you cannot continue your course once you have started, no refund will be given
Please note that deposits are non-refundable and you should take out insurance against late cancellation of booking. Medical and holiday insurance is also strongly advised for all students, a copy of which should be brought with the student.
NEW FOREST LANGUAGE SCHOOL cannot accept responsibility for medical expenses, loss of property or money or refund of fees in the event of cancellation.
3. Course Changes
New Forest Language School makes every effort to provide the course programme as advertised but reserves the right to waive or adjust the specifications of the course without prior notification, where circumstances beyond our control necessitate such changes.
4. Course Cancellation
If the minimum number of bookings required to run a programme is not met, New Forest Language School may cancel the course. In such cases you will then have the choice of taking an alternative course (and where this is of a lower price we will refund the difference) or withdrawing from the booking and accepting a full refund of all monies paid.
5. Force Majeure
No compensation is payable if any aspect of the programme has to be changed or altered in any way due to circumstances beyond our control. This covers incidents and circumstances such as war, terrorism, riot, natural or manmade disaster, pandemics, fire, adverse weather, technical problems, breakdowns, closure or congestion at airports or ports or industrial dispute.
6. Own arrangement
We cannot be held liable or responsible for any elements of your trip which are considered "own arrangement" and that are not included in our package. We recommend that sufficient insurance is therefore obtained.
All information and advice given by us about travel arrangements, tourist attractions etc. is given in good faith.
7. Travel and Medical Insurance
It is strongly recommended that all students have appropriate travel and medical insurance. Such insurance should ensure that you are properly covered against unexpected cancellation charges, medical costs, repatriation, and loss of money or personal belongings and personal injury claims. New Forest Language School, its representatives and staff will not be liable for loss, damage, illness or injury to persons or property. It is the student's (for young learners the parents' or guardians') responsibility to take out personal insurance against such risks. Please ensure that the student brings all necessary insurance documents with them.
8. Health Declaration
Students (for young learners the parents or guardians) must report on the enrolment form any mental or physical illness, allergy, disability or condition that might interfere with their ability to successfully participate in the programme, that may impact the health or well-being of any other student or staff member or that may require monitoring, treatment or emergency intervention of any kind during the student's anticipated period of enrolment.
New Forest Language School must be notified of any changes to health given at the time of booking.
New Forest Language School reserves the right to terminate a student's enrolment in the programme if the student's participation represents a risk to their own health and safety and well-being or to the health and safety and well-being of other students or staff. No refund will be given in this event and all cancellation costs or costs of repatriation will be the responsibility of the parents/guardians and New Forest Language School strongly recommends that students have adequate personal insurance to cover this.
9. Medical Consent
In the event of a serious accident or illness, New Forest Language School will inform parents/guardians or next of kin immediately and, for this purpose, it is essential that you provide us with an emergency address and telephone numbers during the time of your or your child's stay with us.
In the event of serious accident or illness, your authority and/or the authority of the parent/guardian is required before emergency medical, surgical or dental treatment can be given. We therefore strongly recommend that consent is given to New Forest Language School on the Declaration and Consent Form.
10. Course Participation
It is a condition for all students participating in one of our holidays that they agree to accept the authority of any decision of our employees, representatives and local coaches. Student must at all times strictly comply with the laws and customs of the country.
11. Expectations of students (under 18)
- Students are expected to behave sensibly, appropriately and reasonably at all times, and to show proper consideration for other people,
Students must attend all lessons and are expected to participate in the extra-curricular activities,
No smoking or consumption of alcohol or use of illegal drugs is allowed at any time on or off the course,
Students much comply with any rules and regulations designed to assure their safety, including permission to go out unsupervised and fire regulations.
All teenagers and young learners under the age of 18 are expected to behave appropriately on all New Forest Language School courses and we reserve the right to repatriate any student at any time at the parents'/guardians' expense if we consider the student's behaviour to be detrimental to the general welfare of the school. In such cases, there will be no refund of fees.
Parents/guardians are expected to discuss these expectations with young learners and ensure that they are fully aware of them.
12. Complaints Procedure
We hope you will be fully satisfied with the courses and programmes that we offer, but if you have a complaint about our services please inform one of our directors in writing before the date of departure. We aim to revolve any issues instantly, so we ask you to bring any problems to our attention straight way. We will take your complaint seriously, and will address it and respond to it as quickly as possible.
13. Our Responsibility
We accept liability for the proper performance of the course sold to you. We have taken reasonable care to ensure that our suppliers are reputable, safe and efficient businesses. We will monitor and control the performance of our suppliers and judge their performance against the standards and customs in England. We cannot accept liability in the following circumstances:
- If the failure or improper performance is your fault or the fault of any member of your party
- If the failure is the fault of someelse connected with the provision of events travel or itinerary which you or third parties unconnected with us have arranged
- Liability for any loss or damage that has special financial consequences
- Any unusual or unforeseeable circumstances beyond our reasonable control
Please note that in the event that any compensation is payable by us to you such compensation will not exceed twice the cost of your course. It is a condition of our acceptance of liability that you follow the procedures for the notification of complaints as set out in section ?? below.
14. Consumer Protection
We carry full liability insurance and consumer protection provided through International Insurance Company of Hannover Limited.
15. Photographs, video and DVD (for students under the age of 18)
During our courses we sometimes take photographs and video footage, some of which may be incorporated into future publicity material. If you do not wish your son or daughter to appear in any promotional publications, please indicate this on the Declaration and Consent Form.
16. Data Protection
To ensure smooth running of our courses and in order to process your application, we must pass your details and/or details of your child to other services related to your stay. This may include, but is not limited to, accommodation and transfer services.
We will also use the information to keep you informed of any future courses which we think will be of interest to you. Please inform us at the time of booking if you do not wish us to use your information in such ways.
In accordance with the Data Protection Act 1988 you are entitled to see the information relating to you personally which is held by us manually or on our computer system. For further information please see our Data Protection Policy.
17. Permission to go out without supervision
Students under the age of 16 are not permitted to leave the Course Centre/Homestay Accommodation without adult supervision or written parental consent. On excursions, there is sometimes a limited period of free time during which students may, in small groups, explore the area to go shopping or complete an activity.
18. Validity of conditions
These Terms and Conditions are subject to English Law and the English language version is legally binding in all cases.
